UniPlace Terms of Service

1. Introduction
Welcome to UniPlace. These Terms of Service ("Terms") govern your access to and use of the UniPlace platform, which provides a listing service for short-term rental accommodations. By accessing or using the website, you agree to comply with these Terms.
2. Definitions
- "UniPlace," "we," "us," or "our" refers to the operator of the UniPlace platform.
- "Service": the UniPlace website and all associated features.
- "User," "you," or "your" refers to any individual who accesses or uses the Service.
- "Content" refers to all text, images, videos, and other materials posted on or through the Service.
3. Account Registration
3.1 Eligibility
To use UniPlace, you must be at least 18 years old and able to form legally binding contracts under applicable law.
3.2 Account Registration
- Accounts may be created using Google OAuth.
- You are responsible for maintaining the security of your credentials.
- You agree to provide accurate and updated information.
4. User Conduct
4.1 Prohibited Activities
- You agree not to use the Service for unlawful purposes.
- You agree not to post misleading, discriminatory, or illegal content.
- You must comply with all applicable laws, including the Ontario Human Rights Code.
- Automated scraping or data mining is prohibited.
- You agree not to:
- Impersonate any person or entity
- Harass, abuse, or harm another person
- Post duplicate listings or spam other users with repeated messages
- Interfere with the proper operation of the Service
- Attempt to access areas of the Service you are not authorized to access
- Use automated scripts to collect information from the Service
4.2 Content Guidelines
All listings and communications must:
- Be accurate and truthful
- Not contain discriminatory statements or preferences
- Not contain offensive, inappropriate, or illegal content
- Not infringe on the rights of others
4.3 Monitoring Communications
By using our messaging system, you consent to limited monitoring for safety, moderation, and policy enforcement, in compliance with Canadian privacy law.
5. Listings
5.1 Listing Creation
- You are responsible for the accuracy and legality of your listings.
- Listings must comply with all applicable housing, tenancy, and university residence regulations.
5.2 Responsibility for Listings
You are solely responsible for the content of your listings and any transactions that result from your listings.
5.3 Listing Removal
We reserve the right to remove any listing for any reason, including but not limited to violations of these Terms.
6. User Safety and Protection Against Fraud
6.1 Rental Payments and External Transactions
UniPlace does not process rental payments or deposits. All financial transactions occur outside of our platform between the parties involved. You acknowledge and agree that UniPlace is not liable for any payment-related issues, scams, or fraudulent activities that may occur.
6.2 Safety Practices
You are responsible for your own safety and for practicing caution when using UniPlace. We strongly recommend:
- Meeting in public places when viewing properties
- Bringing a friend when meeting strangers
- Verifying the identity of individuals you communicate with
- Never sending money to someone you haven't met in person
- Being alert to common rental scams

7. Intellectual Property
7.1 Our Content
The Service and its original content, features, and functionality are owned by UniPlace and are protected by copyright, trademark, and other intellectual property laws.
7.2 Your Content
By posting content on UniPlace, you grant us a non-exclusive, royalty-free, worldwide license to use, modify, reproduce, and distribute that content on our Service.
8. Disclaimer of Warranties
UniPlace is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
9. Platform Role and Liability Disclaimer
- UniPlace is a neutral listing platform that connects users for the purpose of subletting and rental inquiries. We do not facilitate lease agreements, process payments, or verify the identity or legitimacy of users or listings.
- All communications, negotiations, and transactions occur directly between users and are conducted independently of UniPlace.
- By using the platform, users acknowledge that UniPlace is not liable for any agreements, disputes, losses, damages, or harm arising from user interactions or listings. We make no guarantees regarding the accuracy, legality, quality, or safety of any listings or users.
- Users are solely responsible for conducting their own research and due diligence before entering into any agreements.
10. Limitation of Liability
10.1 General Limitation
To the maximum extent permitted by law, UniPlace shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service or any content therein, regardless of whether such liability is based on warranty, contract, tort, or any other legal theory, and even if we have been advised of the possibility of such damages.
10.2 Force Majeure
UniPlace will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, civil unrest, embargoes, labor disputes, or governmental regulations.
11. Indemnification
You agree to indemnify and hold harmless UniPlace from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service.
12. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.
13. Changes to Terms
We may revise these Terms periodically. The most current version will be posted on our site. By continuing to use the Service after updates are posted, you agree to be bound by the revised Terms.
14. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada.
